PUBLIC RECORDS REQUEST POLICY

As defined in FS 119.011(12), “Public records” are all documents, papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software, or other material, regardless of the physical form, characteristics, or means of transmission, made or received pursuant to law or ordinance or in connection with the transaction of official business by any agency. The Supervisor of Elections office (SOE) is not required to fulfill a public records request if no such responsive records or information exists, nor are we required to reformat or customize records to suit the requestor’s needs.

VOTER INFORMATION AS PUBLIC RECORD

Once filed, with few exceptions, information on registered voters is public. Confidential or exempt information includes:

  • Voters’ driver license numbers, Florida ID numbers, or Social Security numbers

  • Records for pre-registered voters (16 and 17-years-old)

  • Information related to where a voter registered to vote

  • Identifying information of voters with high-risk professions or victims of certain crimes; often referred to as “protected voters”

ADDITIONAL RESTRICTIONS ON PUBLIC RECORDS

The SOE follows the standards for the inspection and copying of records as set by FS 119.07; however, may run into restrictions when fulfilling requests. This may be due to other mandates including the following:

  • Information related to critical infrastructure

  • Records related to cybersecurity, network schematics, or hardware and software configurations

  • Trade secrets that are held by an agency

Any public records requests that are denied, will be provided with the statute, rule or policy that prevents the release of that information.

If possible, all records will be provided in an electronic format. Fee changes in effect beginning February 2023.

SUBMIT A PUBLIC RECORDS REQUEST

Public records requests can be submitted from the SOE’s website: www.CollierVotes.gov/RECORDS. By submitting requests online, requestors will be able to create a NextRequest account that allows them to access the status of their request at any time and communicate directly with the records custodian.

All public records requests must include the requestor’s contact information in order to fulfill the request appropriately. Please note that all public records requests are considered public records for up to one year of the request date – including the requestors’ provided contact information. If a response for clarification is not received by the person making the records request within 30 calendar days, the request will be closed and the requestor will then need to resubmit the request.
